One-Off Task Terms & Conditions
By requesting and paying for a one-off task (“Task”) from SKUNKWORK (“Provider”), the requesting party (“Customer”) agrees to the following terms and conditions:

Task Execution:
- Web Maintenance/Fix Tasks: All One-Off Web Maintenance/Fix Tasks are completed within 24 hours of payment confirmation. Subscribers benefit from completion within 1 hour during working hours.
- Graphic Design Tasks: All one-off graphic design tasks are completed within 72 hours of payment confirmation. Subscribers are guaranteed same-day completion (within 24 hours).
- Print Design Tasks: All one-off print design tasks are completed within 72 hours of payment confirmation. Subscribers are guaranteed same-day completion (within 24 hours).
- Working hours are 9am-5pm, Monday to Friday for one-off task only customer. See ‘Opening Hours’ for subscribers here.

Fees & Charges:
- Maintenance/Fix Tasks: All one-off maintenance/fix tasks incur a fee of £99+VAT (fixed pricing may vary depending on the task), payable in advance of task execution, unless subscribed to a plan, in which case the task is free if within the quotas allocated/remaining.
- Graphic Design Tasks: All one-off graphic design tasks are £245+VAT, payable in advance of task execution, unless subscribed to a plan, in which case the task is free if within the quotas allocated/remaining.
- Print Design Tasks: All one-off print design tasks are £245+VAT, payable in advance of task execution, unless subscribed to a plan, in which case the task is free if within the quotas allocated/remaining.
- Scope of Work: The scope of the Task will be agreed upon prior to commencement. Any additional work beyond the agreed scope may incur additional fees. The Provider reserves the right to refuse any requests that fall outside its expertise or are deemed inappropriate.

Customer Obligations:
- The Customer must provide all necessary access, information, and resources required for the Task in a timely manner.
- The Customer must ensure all provided information is accurate and up-to-date.
- Data Loss Disclaimer: The Provider shall not be held liable for any loss of data incurred during the execution of the Task. It is the Customer’s responsibility to ensure that adequate backups are in place before requesting the Task.
- Access to Back-End: For Tasks involving accessing the back-end of websites or digital platforms, the Customer acknowledges and agrees that there may be risks associated with such access, including but not limited to accidental data loss or system disruptions. The Provider shall not be liable for any issues arising from accessing the back-end of websites or digital platforms.

Warranties and Representations:
- The Provider makes no warranties or representations, whether express or implied, regarding the quality, accuracy, or suitability of the services provided.
- The Customer acknowledges that any digital service inherently carries risks and uncertainties, including potential technical errors or limitations.
- Legal Compliance: The Provider agrees to comply with all relevant laws and regulations governing digital services, including data protection laws, during the execution of the Task.
- Confidentiality: Both parties agree to keep confidential any proprietary or sensitive information received during the course of the Task. The Provider will take reasonable measures to protect the Customer’s information but cannot guarantee absolute confidentiality due to the nature of digital transactions.

Intellectual Property Rights:
- Any intellectual property developed or delivered as part of the Task remains the property of the Provider until full payment is received.
- Upon full payment, the Customer will have the right to use the deliverables for the agreed purpose. The Provider retains the right to use any generic, non-customer-specific methodologies or processes developed during the Task.
- Limitation of Liability: The Provider shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in any way connected with the execution of the Task, including but not limited to loss of revenue, profits, or data. The total liability of the Provider under any circumstance shall be limited to the amount paid for the specific Task.
- Indemnification: The Customer agrees to indemnify and hold harmless the Provider against any claims, damages, liabilities, costs, and expenses arising from or related to the execution of the Task, including any breach of these terms by the Customer.
- Force Majeure: The Provider shall not be liable for any delays or failures in performing its obligations due to events beyond its reasonable control, including but not limited to natural disasters, strikes, or technical failures.
- Dispute Resolution: Any disputes arising from the execution of the Task shall be resolved in accordance with the dispute resolution mechanisms outlined in the SKUNKWORK Service Level Agreement.
- Governing Law: These Terms & Conditions shall be governed by and construed in accordance with the laws of England, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
- Acceptance: By requesting and paying for a One-Off Task, the Customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.
Payment & Refund Terms for One-Off Tasks (Non-Subscribers)
By requesting and paying for a one-off task (“Task”) from SKUNKWORK (“Provider”), the requesting party (“Customer”) agrees to the following terms and conditions:
- Payment: The Customer shall pay the specified fee for the Task upon submission of the request. Payment is required in advance of task execution.
- Non-Refundable Fee: Once the Task has been submitted and expedited to a SKUNKWORK engineer, the fee for the Task is non-refundable.
- Refund Policy: If, for any reason, the Provider is unable to complete the Task, a refund will be issued to the Customer. The refund will be processed within 3 working days and returned to the account/card used to pay the fee.

Reasons for Task Incompletion: The Task may not be able to be completed due to the following reasons:
- Inability to access the back-end of the website or digital platform.
- Discovery of critical errors or issues preventing completion of the Task.
- Lack of necessary information or resources provided by the Customer.
- Technical limitations or constraints beyond the Provider’s control.
- Customer Responsibility for Chargebacks: The Customer agrees to resolve any disputes directly with the Provider before initiating a chargeback with their payment provider. Unresolved chargebacks may result in additional fees and legal action.
- Dispute Resolution: Any disputes arising from payment or refunds for one-off tasks shall be resolved in accordance with the dispute resolution mechanisms outlined in the SKUNKWORK Service Level Agreement.
- Governing Law: These Payment & Refund Terms for One-Off Tasks shall be governed by and construed in accordance with the laws of England, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
- Acceptance: By requesting and paying for a One-Off Task, the Customer acknowledges that they have read, understood, and agreed to these terms, and those accompanying terms or conditions referenced herein.
- Security Protocols For Sensitive Data Exchange
- At SKUNKWORK, we prioritize the security and confidentiality of our customers’ sensitive data, particularly when it involves granting temporary administrative access to the backend of websites, such as WordPress, to resolve technical issues. The following protocol outlines our approach to handling sensitive data securely, the steps we take to mitigate potential risks, and the responsibilities of both our team and the customer.
- 15.1. Data Collection and Request Protocol
- When a task requires access to the backend of a customer’s WordPress site or similar platform, we may request that the customer create a temporary admin username and password for our engineers to use. These credentials are requested via one of two secure channels:
- Registered Email Address: We send a request for credentials to the email address registered at the time of the One-Off Task purchase or subscription sign-up.
- Subscriber Dashboard: For subscribers, credentials can be securely submitted through the “Security & Access” section within the Subscriber Dashboard.
- 15.2. Secure Storage of Sensitive Data
- All sensitive data, including admin credentials, are stored securely within the Tidio app. Tidio is a GDPR-compliant platform known for its robust security features, including:
- End-to-End Encryption: Tidio employs encryption protocols that ensure all data transmitted and stored is secure and inaccessible to unauthorized users.
- Access Control: Only authorized personnel within SKUNKWORK have access to the stored credentials. Access is strictly monitored and logged to prevent unauthorized use.
- Data Privacy: Information stored within Tidio is private and not shared with any third parties unless explicitly required by law or necessary for completing the task.
- 15.3. Temporary Nature of Credentials
- We strongly recommend that customers create temporary credentials specifically for the task at hand. These credentials should be:
- Unique: Different from any existing usernames or passwords.
- Temporary: Set to expire after a specific period or upon completion of the task. Customers are advised to delete or deactivate these credentials immediately after our work is completed to further reduce any security risks.
- 15.4. Disclaimer and Customer Responsibility
- While SKUNKWORK takes extensive measures to protect sensitive data, the Company acknowledges and agrees to the following:
- Data Security Responsibility: The customer is responsible for the initial creation and eventual deletion of temporary credentials. SKUNKWORK cannot be held liable for any breaches resulting from weak passwords, failure to delete credentials post-task, or unauthorized access due to customer negligence.
- Potential Risks: Although we utilize secure methods for data exchange and storage, the transmission of data over the internet always carries some level of risk. SKUNKWORK is not liable for any unauthorized access or breaches that occur as a result of data being intercepted during transmission, unless such breaches are directly attributable to our negligence.
- Limitation of Liability: In the event of a security breach, our liability is limited to the direct damages incurred due to our handling of the data, subject to the terms and conditions of our service agreements.
- 15.5. Breach Response Protocol
- In the unlikely event of a security breach:
- Immediate Notification: We will notify the affected customer(s) immediately via their registered email address.
- Breach Containment: Our technical team will take immediate action to contain and mitigate the breach, including disabling compromised credentials and assessing any potential damages.
- Investigation and Reporting: We will conduct a thorough investigation to determine the cause of the breach and implement additional security measures to prevent future incidents. A report detailing the breach and our response will be provided to the affected parties.
- 15.6. Recommendations for Customers
- To further enhance security, we recommend that customers:
- Use strong, unique passwords for temporary credentials.
- Enable two-factor authentication (2FA) where possible.
- Regularly update all passwords and credentials associated with their website.
- By following these protocols, SKUNKWORK ensures that sensitive data is handled with the utmost care, reducing the risk of unauthorized access while maintaining the integrity of the services we provide.
