This is a customer-friendly summary of the key terms. For the complete legal wording, refer to the full Terms & Conditions page.
1. Agreement & Acceptance
- By using, purchasing, accessing your portal, submitting tickets, or making any payment, you agree SKUNKWORK™/SKUNKHOST™ Terms & Conditions apply.
- The agreement governs all services including hosting, maintenance, support, deliverables, and any related service requests.
2. Services Covered
The agreement covers:
- Managed WordPress support and maintenance.
- Website changes, content updates, fixes, and development within agreed service kits.
- Managed hosting services under SKUNKHOST™ plans.
- Any task ordered through the official client portal.
Services excluded from scope may include major redesigns, custom applications, third-party platform integrations, and non-WordPress work unless explicitly agreed.
(Reference the Scope of Work.)
3. Service Requests & Tickets
- All requests must be submitted via the client ticketing system.
- Tickets create the official record and audit trail for tasks and service delivery.
- Work does not commence until a ticket is acknowledged and any prerequisites (e.g. access, completed forms) are met.
4. Turnaround & Service Levels
- Target delivery times are defined based on task type, complexity, and plan level.
- SLAs are targets, not guaranteed deadlines.
- Turnaround pauses for: awaiting client response, third-party dependencies, security checks/verifications, billing issues or non-payment.
5. Billing & Payments
- All services are paid in advance per billing cycle; no hourly billing unless contracted separately.
- Subscriptions and plans renew automatically unless cancelled before the renewal date.
- Payment must clear before work begins; delays may delay task processing.
- No refunds once a billing period begins, except very limited new-client cases.
6. Cancellations
- Clients may cancel services before the renewal date to stop automatic billing.
- Cancellation does not provide refunds for the current period.
- Upon cancellation, hosting and associated resources may be disabled or deleted after a retention period.
7. Deliverables & Ownership
- You retain ownership of all your original content, logos, materials, and data.
- Deliverables (e.g., design files, updates) are licensed for use on your website.
- Any third-party software/components installed remain subject to their original licences.
8. Access & Security
- You grant necessary access (hosting credentials, admin access) for services to be delivered.
- Shared access with your team should be secure; temporary credentials should be removed once work completes.
- You remain responsible for credentials and access security on your end.
9. Backups
- Backups may be taken as part of hosting under SKUNKHOST™, but are best-efforts and not guaranteed.
- You are strongly encouraged to maintain your own off-site backups.
10. Uptime & Availability
- Hosting uptime targets apply based on your plan.
- Credits (not refunds) may be issued for eligible downtime per SLA rules.
- Outages due to third parties, force majeure, maintenance, or security actions are typically excluded from uptime calculations.
11. Liability & Limitations
- To the maximum extent permitted by law, liability is limited to service fees paid in the preceding period (e.g., last 3 months).
- No liability for indirect, consequential, incidental, or loss of business.
- Certain statutory rights remain unaffected.
12. Acceptable Use
You must not use services to:
- Host illegal, infringing, harmful, or abusive content.
- Perform network attacks, spam, malware distribution, or illegal activities.
- Violate third-party rights or regulations.
Breach of acceptable use can result in suspension or termination.
13. Intellectual Property
- You own your content.
- The provider retains rights to system tools, automation, and internal frameworks.
- No transfer of provider’s proprietary IP unless explicitly licensed.
14. Privacy & Data Protection
- Services and access may involve processing personal data under GDPR or applicable regulations.
- Use of services constitutes consent to process data for delivery, billing, security, and compliance.
15. Changes to Terms
- Terms may be updated from time to time.
- Continued use after changes constitutes acceptance.
16. Governing Law
- This agreement is governed by the laws of England & Wales and subject to relevant courts.
